I can't get over the Dean can 'rehabilitate' quote, WTF. Rehabilitate from what? I call it 'the audacity of ungratefulness'. Dean has helped give dems 14 new dem senators and 52 new dem reps, and doesn't even get a thank you, not even a friggin t shirt. Dean has nothing to rehabilitate from. Be careful dems you may reap what you sow.

argument in court and that would be a very strong case or your will be arguing to question the way in which the Constitution has given the states the rights to choose their elected officials. The Constitution gave the state the right to choose it's senators.

Certification is just meaningless paperwork, as is the case of Bushes pardon of Toussie. All you need is notification of the senate or involved parties ( or Toussie himself if he to take with to court), it could be by carrier pigeon for all you know.

I don't think the framers wanted to allow the senate to not seat any senator it pleased, otherwise the majority would not seat the minor by majority vote. No one would have agree to that (I think people are not reading into intent, because if this is argued in Fed court a smart lawyer would argue my point, even though the text of the Constitution does not explicitly say that.). There must be impropriety hence Reid would have to seat Blago and try to expel him with a 2/3 vote but that leads back to my first point (2/3 ganging up one senator they don't like becuase he's black, or a socialist, or from the south, or from alaska) which is kinda unchartered territory.

The only time Reid/Hoyer/Pelosi have any balls is when it comes to to f#@King up other dems and progressive people initiatives that they paid lip service to in the past. Their hands are always tied to push for what is right, if one repug starts a temper tantrum. Gov Blago may be tainted, but Burris is not.
