Thoughts on Day Two of the Sotomayor Hearings

The New York Times didn't think it heard anything yesterday:

The hearings have as a consequence, so far at least, failed to illuminate very much how Judge Sotomayor would approach the work of a Supreme Court justice. She was certainly prepared, apropos almost any question, to say that she would faithfully apply the law to the facts. Asked to describe whether she subscribed to one or another school of constitutional interpretation, she said, "I don't use labels."

I couldn't disagree more that Sonia Sotomayor's testimony yesterday "failed to illuminate very much how Judge Sotomayor would approach the work of a Supreme Court justice." While it may be true that President Obama's nominee did not explicitly say how she would rule on particular cases -- which has been the case in virtually every confirmation hearing in two decades -- Judge Sotomayor displayed a grasp for the intricacies of the law that make her supremely qualified to serve on the highest court in the land. Sotomayor's ability to bat away with both ease and great depth the difficult questions thrown at her by her hostile inquisitors only strengthened my sense that she will be a real force on the court. And if that "fail[s] to illuminate very much how Judge Sotomayor would approach the work of a Supreme Court justice," I am not sure what would.

I think you missed the point of the NYT article She is not going to be labeled but will be a strong minded justice not swayed by others as she was yesterday and even lecturing Sen. Orin Hatch on weapons showing that she is not afraid to challenge anyone or ask difficult questions.

 The more I listen to Judge Sotomayor, the more impressed I become. I have a feeling that we are witnessing the emergence of an historically significant Supreme Court Justice, and a significant threat to any remaining fallacious belief in the superiority of white males. I couldn't be more pleased (as a white male who has benefitted from that accident of birth, I welcome this development because it is about time, imho, that humans correct this longstanding injustice.)

She is a bit passive.  I know she has to be but there were a few times when I thought she could have stuck the knife in a little ... maybe even twisted it.

Nope...It will never happen again...

We will never see an outright contentious appointee, Ala Bork or even Thomas.

The model is, total deference, decorum, and keep chanting one of two mantras:

1. If Republican firebreather (because, it's OK to choose as hard right an appointee as the Federalist Society can create) keep stating your humanity, your belief in settled law (the Roe answer for both sides) and try to NOT appear like the Corporate Shill you probably are.

2. If you are a Democrat, chances are you are a moderate, because we can't POSSIBLY put a liberal on the court...or face the wrath of the media.  So, you as a moderate democrat must disavow ANY left leanings you may have, and appear to be a strict constructionalist, ALA Scalia.

It's a dance, each side knows it's role.

The appointee's fate is known BEFORE the dance starts and only a complete meltdown, as Graham said yesterday, changes this.

You smile, act gracious to questions from clowns who clearly have NEVER had to make a tough judicial decision, but want to lecture you on THEIR tremendous legal background....

And then watch Contessa Brewer sum it all up for us, before returning to the latest Michael Jackson news.

She has strong qualifications and a great life story. In the meantime, Republicans are shocked, shocked that she may draw on her life experiences, show empathy, or have some liberal tendencies.

She will be able to secular version of Sam Alito.  I think she is a feminist rather than being a liberal. And with her on the court that will only affirm the Hate Crimes Legislation that will be passed.
