FBI Arrests IL Gov. Rod Blagojevich On Federal Corruption Charges

Greeeeaaaat.

Illinois Governor Rod Blagojevich (D) has been under federal investigation for three years and now authorities, who have been secretly recording Blagojevich for more than a month, apparently have reason to believe the process by which he is selecting Barack Obama's successor is corrupt.

From The Chicago Tribune:

A three-year federal corruption investigation of pay-to-play politics in Gov. Rod Blagojevich's administration has expanded to include his impending selection of a new U.S. senator to succeed President-elect Barack Obama, the Tribune has learned.

Federal authorities got approval from a judge before the November general election to secretly record the governor, sources told the Tribune, and among their concerns was whether the selection process might be tainted. That possibility has become a focus in an intensifying investigation that has included recordings of the governor and the cooperation of one of his closest friends.

The governor has not been accused of any wrongdoing. The specific contents of the recent recordings have not been disclosed. Blagojevich has said the appointment of a Senate successor, which is his choice alone, could come in a matter of weeks.

Blagojevich remained defiant as recently as yesterday, insisting he's done nothing wrong, but the fact that he's now been taken into custody would seem to indicate, at the very least, an escalation in the investigation. This is a fluid story and very little hard information is being released so we shouldn't jump to any conclusions.

According to the source, the governor is now at FBI headquarters on the city's West Side, where he is in the custody of federal authorities.

Officials are expected to hold a news conference at 11 a.m. Gov. Blagojevich may also make a court appearance.

And what of the man who could very well shortly be the new governor of Illinois and hence the man who may end up making the appointment to the US Senate?

Lieutenant Governor Pat Quinn, reached by phone at home, tells ABC 7 News "I've heard the reports but I don't know whether it's true or not."

Illinois's lieutenant governor says he has not been told of Governor Blagojevich's arrest by federal authorities "through any official channels" but is heading to the Thompson Center now to await more information.

"The Governor remains the Governor... The presumption is you're always innocent until proven guilty," said Quinn.

Quinn is reportedly a good progressive Democrat. More on him HERE.

Update [2008-12-9 10:15:12 by Todd Beeton]:Via press release, this appears to be at least part of the smoking gun:

In the earliest intercepted conversation about the Senate seat described in the affidavit, Blagojevich told Deputy Governor A on November 3 that if he is not going to get anything of value for the open seat, then he will take it for himself: "if . . . they're not going to offer anything of any value, then I might just take it." Later that day, speaking to Advisor A, Blagojevich said: "I'm going to keep this Senate option for me a real possibility, you know, and therefore I can drive a hard bargain." He added later that the seat "is a [expletive] valuable thing, you just don't give it away for nothing."

Illinois Governor Rod Blagojevich was arrested by FBI agents Tuesday morning on federal corruption charges, officials said.

His chief of staff John Harris was also charged, the U.S. Department of Justice confirmed in a statement.

Blagojevich, 51, and Harris, 46, both of Chicago, were each charged with conspiracy to commit mail and wire fraud and solicitation of bribery.A 76-page FBI affidavit alleges that Blagojevich was intercepted on court-authorized wiretaps during the last month conspiring to sell or trade for personal gain the state's U.S. Senate seat, which is being vacated by President-elect Barack Obama.

Pretty pathetic.

Update [2008-12-9 10:29:32 by Todd Beeton]:It is now really important that Blago NOT be the one to make the appointment to the Senate. Blago can resign or even step aside temporarily to let Pat Quinn step into the Governorship. If he refuses, the state legislature would have to impeach him but I suspect the pressure will be great for Blago to step aside, if only so that the appointed new Senator does not have any taint hanging over his or her head. Does this impact who that appointee will be? Distance from Blago and a squeaky clean reputation probably just became really important qualities in a candidate.

Throughout the intercepted conversations, Blagojevich also allegedly spent significant time weighing the option of appointing himself to the open Senate seat and expressed a variety of reasons for doing so, including: frustration at being "stuck" as governor; a belief that he will be able to obtain greater resources if he is indicted as a sitting Senator as opposed to a sitting governor; a desire to remake his image in consideration of a possible run for President in 2016; avoiding impeachment by the Illinois legislature; making corporate contacts that would be of value to him after leaving public office; facilitating his wife's employment as a lobbyist; and generating speaking fees should he decide to leave public office.

Update [2008-12-9 10:51:19 by Todd Beeton]:Chuck Todd: The IL legislature is not set to come back into session until after Jan. 1st. The only way for them to return before then would be for Blagojevich to call them into session, not likely if it means his impeachment. You may now see a push for the appointment to be a caretaker position, in other words just a 2 year appointment until voters can elect a replacement in 2010. All the people who previously wanted the seat now don't want to touch it with a ten foot pole, unless Blagojevich decides on his own to step aside to let Pat Quinn assume office, about which, says Todd: "watching Blagojevich, it's unlikely this guy would resign any time soon."

Update [2008-12-9 11:0:14 by Todd Beeton]:David Kurtz cites a particularly brazen quote from the Blago that was caught on tape by the feds. Here he is discussing appointing himself to the Senate:

"I've got this thing and it's [expletive] golden, and, uh, uh, I'm just not giving it up for [expletive] nothing. I'm not gonna do it. And, and I can always use it. I can parachute me there."

Has anyone been on Keith's best AND worst persons lists during the same episode? I think Blgojevich has earned that.

This is very conspiratorial, but at the same time, could have a ring of truth.   Maybe this is the last harruh of corruption of the Bush Justice Department.

Then again, we have been worried for a while what Rod Blagojevich would do with the replacement.  Could he really be that stupid that while he knew he was already under investigation that he would pull a stunt like this?

Stevens was found guilty despite the case made by Justice, not because of it.  I'm not convinced that they wouldn't take one last Hail Mary at Obama's home state, knowing the famous allegations of Chicago corruption.

FItzgerald's reputation was that he wouldn't go for an indictment unless he felt pretty damn sure of a conviction, IIRC. That's why he didn't indict Rove.

I've been wishing everyone at work a happy morning with this information. And I have called all of my family to let them know the good news as well.

My friend and I were laughing about this, and the fact that there's been so much sincere speculation over why Blago was taking so much time with his Senate pick. Of course, he's been waiting for the highest bidder! Of course, because there are no limits to both his stupidity and his crookedness.

I think so many of us in Illinois have been waiting for this day for a while now...

After all the mostly Republican scandals uncovered in the last couple years, why oh why is there always someone else waiting in the wings who thinks they're a bit more clever than the rest. It's maddening, and I just hope it's not misused in an effort to taint Obama in any way.

How the hell did the local party mess up so badly to let a guy like this become governor? Did this guy become like this only after he became governor? Any background on this guy?

This is why the Dems should never have wussed out in going after all the corrupt Bushies and other war profiteers. The whole moving forward memo used by the likes of lieberman and other Bush apologists is just an excuse. Republicans will have no problem going after corrupt Democrats and that's the way it should be. Each party needs to serve as a check on the other.

I hope this governor gets wiped out with jail time and fines if he is the slightest bit guilty.

I don't think just saying these things actually constitutes "Guilt beyond a reasonable doubt". It is my understanding that one must actually recceive a bribe to be guilty of one. In my post GONZO mind I wonder if this might be a "I better indict him now before I have to resign' indictment. I think the DA may be pinning his hopes on getting Harris to flip. We will see.

One additional point, As of now I have not heard a name of anyone who was directly or indirectly asked to pay the Gov money or provide any form of prid quo pro. The word Value doesn't actually have to mean a bribe. Value could me political support or fund raising etc. Besides this could all just have been talk. Remember talking about doing a crime does not mean you are going to actually committ one.

Yes, but he's accused of being a crook, not just a bad governor.  The point is valid, although I assume they have something on him more serious than just musing about "value."

I mean, even if I sit around with my chief of staff going "hey, maybe someone would pay me a million bucks for this Senate seat!" it's still not a crime.  You'd need some sort of overt act in furtherance of a conspiracy, at a minimum.

So, who the hell picks our Senator now??? I don't know the legality of a remaining Illinois Governor after being arrested, but I know Blago will NEVER resign (this fool was raising money for reelection with a 10% approval rating), and court cases take time. And if he remains governor, will we let him choose the new Senator? And who in their right mind would accept the position from Blagojevich after all this? Does the Senate have to choose the replacement now?

What a freaking embarrassment for Chicago. As my mother said, it makes Obama even more refreshing. That he came out of Chicago politics and was somehow so squeaky clean.

From Article V, Section 6 of the Illinois Constitution:

SECTION 6. GUBERNATORIAL SUCCESSION

(b) If the Governor is unable to serve because of death, conviction on impeachment, failure to qualify, resignation or other disability, the office of Governor shall be filled by the officer next in line of succession for the remainder of the term or until the disability is removed.

(c) Whenever the Governor determines that he may be seriously impeded in the exercise of his powers, he shall so notify the Secretary of State and the officer next in line of succession. The latter shall thereafter become Acting Governor with the duties and powers of Governor. When the Governor is prepared to resume office, he shall do so by notifying the Secretary of State and the Acting Governor.

(d) The General Assembly by law shall specify by whom and by what procedures the ability of the Governor to serve or to resume office may be questioned and determined. The Supreme Court shall have original and exclusive jurisdiction to review such a law and any such determination and, in the absence of such a law, shall make the determination under such rules as it may adopt.

the groundwork for impeachment has been laid...

fritchey has been working on it for over a year.  the house is certainly willing (and able) to move quickly.  i'd be shocked if the state senate would delay if they did.

we can't know the answer to your question until after blago goes before the judge.  i certainly wouldn't venture a guess before then...

The guy has been into pay-to-play for a very long time, the wiretaps are utterly damning, and everyone in Illinois knows this (hence his 10% approval rating). In a court of law, sure, innocent until proven guilty. But we need to hold our politicians to a higher standard, especially those who are nominally democrats.

There's a very good reason why we CANNOT tolerate this level of impropriety - if this had happened 2 months ago, it could have been devastating in the general election. The democrats house needs to be in order, and we need to make it very clear that Blago will have no support from the democratic party. He needs to resign, now.

Yeah Blagojevich has been in his happy place for a long time hasn't he?  He thrives in a world built upon denial.

I'm just hoping that an enormous amount of demands and pressure will induce him to at least let Pat Quinn take over temporarily.

I'm so glad though.  I remember how well he ran his first Gov campaign and how exciting it was to have someone insist on bringing ethics back into the office.  I didn't scrutinize the political press every day so my first hint that he was more of the same was when he thought nothing of a political connection giving his daughter a $2k gift.

The damage he has caused our state is significant and I will be so glad when he is sharing the same facility with George Ryan.

I have a very good feeling that Blagojevich will not resign. I don't think he'll let Pat Quinn take over. He thinks so highly of himself, and probably believes he has done nothing wrong.

He will be our 4th governor to go to jail, according to First read. Boy, I feel so foolish for laughing at Alaska for almost reelecting Stevens.

as the Supreme Court ruled in the case with Adam Clayton Powell in the 1960s.  
But they can expel him/her the moment that the seating has been taken.  And that's what they should do.

Rod Blagojevich should go immediately, and Obama should call for him to resign now.

Senate Candidate 1 is almost certainly Valerie Jarrett. This does not mean she did anything wrong. In fact, probably the opposite.

Senate Candidate 5 is almost certainly Jesse Jackson, Jr. That's a shame 'cause I really like him.

What I mean is that Senior does not have a good approval/disapproval ratio from the people of Illinois.  And unfairly that becomes a challenge for his son.

I have heard Senior speak, as a matter of fact.  I don't want to get into it because it is beside my main point.  But let me say I'm glad you heard him give two great speeches.

Blagojevich and Jackson, Jr had a face-to-face, sit-down meeting yesterday. The affidavit says that Blagojevich, on December 4, mentioned that he was meeting in-person with Senate candidate 5 "in a few days." Blagojevich hasn't had meetings with any other candidates in the last few days.

Obama lets it be known that he prefers Valerie Jarrett.  Blago wants something in return (ambassadorship, head of HHS, whatever).  Obama tells him to go to hell.

Blago then starts talking to Jesse Jackson Jr. and tries to shake him down (for fundraising assistance).  Jackson may have taped his conversations with Blago (they talked yesterday).  Fitz arrests Blago this morning.  It fits together.

Anyone who had "pay to play" discussions with Blagojevich, given the cloud that has been over him for some time, is either a fool or very desperate for the Senate seat.  It's something of a political IQ test, since you ought to know the Feds are lurking out there.

This whole set of facts regarding the Senate seat is a total gift to Fitz, since he surely wanted to nail the guy before a new US Attorney gets appointed.

but the tradition of pay to play is so strong here, especially in chicago, that politicians don't look at it (rules against pay to play) as hard and fast, but as a mere impediment that they have to get around so as the perception of pay to play doesn't exist (in their minds).  illinois pols are actually horrified when you mention that their normal practices are basically corrupt...

If you read upthread, there is a statement by Blagojevich that fairly proves that the Obama team wasn't going to give him anything. Of course, Faux "News" et al will jump on this like a bulldog on a salami, without regard to the facts.

As for the governor, fry him. The last thing we need is a piece of crap like that with a (D) beside his name.

I wish it happened before the election.  If this is going to taint Obama and the Democrats for the next two years, I dont even want him in the White House.

Republicans will try to pin it on Obama

Like they did with all of the Clinton scandals in the 1990s that cost the Democrats very badly.  If Obama is just going to be tangled up in all of this, there is no use in having him there in first place.

The Bushies have scandals that dwarf this. All Obama has to do is retaliate with a thousand investigations into the corruption scandals under Bush.

If Obama can disassociate himself from Wright who did nothing illegal, I am sure Obama will not have a problem condemning this guy. Obama should just issue a blunt statement saying that there is no place in the party for such scum.

the one thing that the rest of us learned...

is that barack is not the clintons.  this indictment is simply ANOTHER EXAMPLE of the "old politics" that barack ran against.  the rest of the country understands this.

you'd have a much better chance of using this indictment to taint a hillary presidency than an obama presidency.  she was running in the old politics vein.  barack was not.  this is exactly the kind of change he ran on.  no more pay to play, no more old politics.  but, like barack said, there are definitely democrats who would rather lose than rule...

Don't get me wrong, I have high esteem for most narcs, because corruption needs to be addressed... but some folks don't respect someone who will blow the whistle because it's the right thing to do.

Innocent Until Proven Guilty

I have a two word cautionary note regarding Governor Blagojevich:  Don Siegelman.

Political bluster can get awful rough.

Governor Blagojevich is innocent until proven guilty with competent evidence by the unanimous verdict of 12 of his peers.  

I simply do not trust the Bush Department of Justice in any case, big or small.

A legal maxim has it that--

●  If you have the facts ... pound the facts.  

●  If you have the law ... pound the law.

●  If you don't have the facts and you don't have the law ... pound the table.

"Lincoln would roll over in his grave" is table pounding.

Moreover, there is just a big "ick" factor where criminal charges are lodged preemptively because something bad seems likely to happen.
